Will an algorithm select employers for PIP inspections?

The media are increasingly reporting on a new inspection model for the State Labour Inspectorate (“PIP”) that is to be based on targeted checks of entities selected on the basis of risk analysis. This is also confirmed by the PIP's programme for action in 2026.

The reform of PIP, which includes granting inspectors the authority to issue administrative decisions confirming the existence of employment, also contains provisions on the creation of a special system for the exchange of information between the Social Security Institution (“ZUS”), the National Revenue Administration (“KAS”) and PIP. The system is to be operated by ZUS and will enable an analysis of the risk of breaches of labour law, legality of employment, tax law, and social security and health insurance. PIP in using the new system could, for example, select entities having a high level of non-employee workers (engaged under civil law contracts) for inspection to check the lawfulness of such contracts.

Work on the reform of PIP is still ongoing. The latest version of the bill was published at the end of January.
