The need to enact legislation on franchising was discussed at the aforementioned meeting, in addition to government members, by the Chief Labor Inspector, representatives of franchisees and other experts. Among arguments in favor of the legislative initiative, they mentioned, in particular, the advantage of franchisors and their ability to impose unfavorable terms of cooperation on their counterparties, e.g. as to work on Sundays, opening hours of premises or pricing policies.
In 2024, the European Union adopted Directive 2024/2831 on improving working conditions through platforms. The aim of this regulation, which we wrote about in more detail on our website, is to improve the situation of those providing labor through digital platforms (e.g. drivers, food suppliers). Directive 2024/2831 introduces, among other things, a rebuttable presumption of employment of such persons within the framework of an employment relationship if there are circumstances indicating control and direction of the platform.
