Polish legislation implementing the platform directive ready later this year?
In 2024, the European Union adopted Directive 2024/2831 on improving working conditions through platforms. The aim of this regulation, which we wrote about in more detail on our website, is to improve the situation of those providing labor through digital platforms (e.g. drivers, food suppliers). Directive 2024/2831 introduces, among other things, a rebuttable presumption of employment of such persons within the framework of an employment relationship if there are circumstances indicating control and direction of the platform.
The deadline for Poland to adopt Directive 2024/2831 is December 2026. In her recent response to a parliamentary interpellation, the Minister of Family, Labor and Social Policy stated that the topic of implementing the subject EU regulations will be discussed by the Social Dialogue Council. She also announced the expectation that draft legislation implementing the directive will go to consultation (and therefore will most likely be made public) already in the second half of the year.
