New General Inspectorate of Labour („GIP”) self-assessment checklist
Chief Labour Inspector Janusz Krasoń has drafted a draft self-assessment checklist that is meant to help employers assess whether they have chosen the correct basis for employment. This is the GIP’s second attempt at the document – the previous version, comprising 42 questions, was drafted by Marcin Stanecki. The tool is linked to the reform of the National Labour Inspectorate (PIP) of 8 July 2026, which permits inspectors to recategorize civil law and B2B contracts as employment relationships.
The list has 30 questions concerning, amongst other things, subordination, the organisation of work, the time and place of work, and responsibility for business risk. Answering ‘yes’ to most of them, particularly questions 9-13, could indicate the existence of an employment relationship.
Experts appreciate that the tool is helpful, but indicate shortcomings: the omission of the position and intent of an employee, the lack of a mechanism for weighing replies, and the failure to group the questions under the three statutory criteria in article 22 § 1 of the Labour Code. The document is not final – GIP awaits comments from members of the Labour Protection Council.
