A parliamentary proposal for the salary transparency bill increasingly likely to be approved
The second reading of the parliamentary proposal for the salary transparency bill is envisaged even in the next parliamentary session in the Sejm (at the beginning of May). We discussed the original version of the bill in an article on our website. In April, a Sejm subcommittee approved a new, shorter version of the bill, drawn up in consultation with officials at the Ministry of Family, Labour, and Social Policy.
Following the amendments to the parliamentary proposal, the only solutions retained are those concerning salary transparency during recruitment:
- a duty to inform a job applicant, on paper or in electronic form, of the starting salary or range of the starting salary, and, where appropriate, of the relevant provisions of collective bargaining agreements or salary policies:

- in the job vacancy announcement,
- prior to the job interview, or
- in other cases – before the employment relationship is established,

- a duty to use gender-neutral language in the job vacancy announcement and in job titles, and to prevent discrimination during the recruitment process,
- a rule under which it is forbidden to ask a job applicant about their current salary or salary received in past employment relationships.
The changes are to take effect six months from the day on which the act is promulgated. At the same time, work is underway at the Ministry of Family, Labour, and Social Policy on a bill to implement in full the remaining provisions in the EU Pay Transparency Directive.
